Bankruptcy Process
Get the Guidance You Need in the San Diego, California Bankruptcy Process
Once you have made the decision to file for bankruptcy and you have hired an experienced bankruptcy lawyer, you can begin the bankruptcy process. Depending on your situation and circumstances, the length and ease of the process will vary. In Chapter 7 and Chapter 13, the process is treated differently and there are different requirements that must be met in each of these cases.
At American Debt Relief, we will guide you through the bankruptcy process so that you can feel confident about your case. At your free initial consultation, attorney Leonard J. Ackerman will meet with you to obtain and analyze any necessary information. This information includes details about the types and amounts of debt you have, your income and where you live. The Bankruptcy Code, rules and regulations of Federal bankruptcy courts and local bankruptcy courts dictate who can discharge debts through bankruptcy and what debts can be discharged.
In order to best guide you through the process, attorney Ackerman will provide a Bankruptcy questionnaire. These questionnaires will give attorney Ackerman the background to be able to best help you through the bankruptcy process.
After our firm prepares your case, your lawyer will review each and every part of the bankruptcy process with you in order to make sure that you are comfortable with what is happening. We will also prepare you for the meeting of creditors that you will have to attend and for bankruptcy court if you are required to appear there. Often, debtors are not required to appear at Chapter 7 or Chapter 13 Bankruptcy court.
After Filing for Bankruptcy
If you have filed for Chapter 7 bankruptcy, an automatic stay is put on all collection activities until the bankruptcy is completed. After filing, you will receive notification that your debts have been discharged and that you are no longer liable to creditors. Once you receive this letter, your bankruptcy is over and you can begin repairing your credit. In Chapter 13, you are always protected from collection activity as long as you remain faithful to the requirements of the repayment plan.
